1. Introduction

These Terms and Conditions govern the use of services provided by Auspico Management, LLC, doing business as UpSkyImages ("we," "us," or "our"), including drone photography and related offerings. By accessing or using our services, you agree to be bound by these terms. If you do not agree, please refrain from using our services.

2. Services

We provide professional drone photography services, including aerial imaging of properties and landscapes. All services are subject to availability, weather conditions, and applicable laws. Specific details of each service will be outlined in a separate agreement or order confirmation.

3. Eligibility

You must be at least 18 years old to use our services. By using our services, you represent that you have the legal capacity to enter into a binding agreement.

4. Payment Terms

  • All prices are quoted in U.S. dollars and are exclusive of taxes unless otherwise stated.

  • Payment is due in full upon completion of services unless otherwise agreed in writing.

  • We accept payment via [list accepted methods, e.g., credit card, bank transfer]. Late payments may incur a fee of 1.5% per month.

5. Intellectual Property

  • All photographs, images, and related materials produced by us remain our property until full payment is received.

  • Upon payment, you are granted a non-exclusive, non-transferable license to use the images for personal or commercial purposes as agreed, subject to restrictions outlined in the service agreement.

  • You may not reproduce, distribute, or modify the images without our prior written consent, except as permitted under the license.

6. Client Responsibilities

  • You are responsible for providing accurate information, including property access permissions and any required authorizations (e.g., FAA approvals).

  • You must ensure a safe environment for our drone operations, free from hazards or restricted airspace violations.

7. Limitations of Liability

  • We are not liable for any indirect, incidental, or consequential damages arising from the use of our services.

  • Our liability is limited to the amount paid by you for the specific service provided.

  • Services may be affected by factors beyond our control (e.g., weather, technical issues), and no refunds or compensation will be provided for such delays unless otherwise agreed.

8. Cancellation and Refunds

  • Cancellations must be made in writing at least 48 hours prior to the scheduled service date to receive a full refund.

  • Cancellations within 48 hours may incur a 50% cancellation fee.

  • No refunds will be issued after service commencement.

9. Governing Law

These Terms and Conditions are governed by the laws of the State of Florida. Any disputes will be resolved in the courts of Miami-Dade County, Florida.

10. Amendments

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting on our website, and your continued use of our services constitutes acceptance of the updated terms.

11. Termination

We may terminate or suspend your access to our services at our discretion if you breach these terms. Upon termination, all rights granted to you will cease.
